Do I Pay Rent During Mold Remediation?
Assume rent is still due until your landlord agrees otherwise in writing or a lawyer advises you. California has no simple rule we can point to for rent during mold work. Ask your landlord in writing about rent, lodging and your move-back date, and call LAHD or your local code agency if you get stuck.

The short answer
Do I have to pay rent while I’m out during mold remediation?
The safe assumption is yes, until you have something better in writing. We can’t point to one California statute that answers this for every renter. The result can depend on your lease, your city, what caused the mold and how long you’re out.
You still have rights. Under the implied warranty of habitability and Civil Code 1941 and 1941.1, a landlord must keep a unit fit to live in. Since SB 655, visible mold growth is a substandard condition under Health & Safety Code 17920.3, except minor mold on surfaces that normally get wet. So a renter who can’t use the unit may have grounds to ask for a rent credit. That is something you negotiate, or a lawyer claims for you, not something to take on your own.
Stopping payment yourself carries the same risk as withholding rent over mold: unpaid rent can lead to an eviction case, even when your complaint is real.
You may not need to leave at all. A contained bathroom or closet job usually lets a household stay while the area is sealed off. See how long mold remediation takes for typical timelines. If someone at home has asthma or a weakened immune system, talk to your doctor first.
Relocation and hotels
Will my landlord pay for a hotel or relocation?
Don’t assume either way. We can’t point to a state law that gives every renter a hotel, or one that says a landlord never owes it. So ask. Common requests are a paid hotel stay, a vacant unit in the building, or a rent credit for the days you can’t live there. Get any yes in writing before you book, and keep every receipt.
In a unit under the LA Rent Stabilization Ordinance (RSO), ask LAHD whether any local relocation rules apply before you agree to leave. Don’t sign anything ending your tenancy without advice.
| Your situation | About rent | Get in writing |
|---|---|---|
| Work is sealed off and you stay home | Expect rent to continue; ask for a credit if you lose a room | Dates, work hours, rooms affected |
| Out for a few nights | Ask for a credit or paid lodging | Who pays, which nights, what amount |
| Out for weeks | Get legal advice before changing payments | Lodging, move-back date, same rent and lease terms |
| Told to leave with no plan | Sign nothing; call your code agency and legal aid | The landlord’s request and reason |
General examples, not rules. Your rights depend on your lease, city and facts.
Constructive eviction
Is being forced out by mold a constructive eviction?
It might be, but that is a question for a lawyer. Constructive eviction is the legal term for a landlord letting conditions get so bad that a tenant is effectively forced out, with no eviction notice served. Serious mold the landlord ignored may raise the issue.
It isn’t a shortcut. If you move out, stop paying and a court disagrees, you could still owe rent, and an RSO unit is hard to replace. Talk to Bet Tzedek or a tenant lawyer first, and bring your records:
- Notice: dated letters, emails and texts showing when the landlord knew.
- Severity: dated photos, plus any inspector’s report or lab results.
- Costs: hotel and storage receipts.
An official citation can also matter: under Civil Code 1942.4, a landlord who doesn’t correct a cited condition can owe damages. See our California mold laws guide.
Put it in writing
How do I ask my landlord about rent and relocation in writing?
Ask before you move out, and ask specific questions.
- Send a dated request. Adapt the wording below, or start with our mold letter to your landlord. Use certified mail, keep a copy, and confirm any phone call by text or email.
- Keep paying unless advised otherwise. Current rent keeps you in the strongest position.
- Check the job before you return. Ask how the moisture was fixed. Independent clearance testing can confirm the work passed.
The LAHD route
What if my landlord won’t answer or the work never starts?
File a code complaint. In the City of Los Angeles, call the LAHD Code & Rent Helpline at (866) 557-7368. The inspection is free. LAHD aims to contact you within 72 hours, or 24 if urgent, and owners get up to 30 days to fix a violation.
Ask what LAHD can and can’t require on rent or temporary moves. A code case is about repairs, so it may not settle your hotel bill. That part is for legal aid.
Outside the city, call LA County Public Health at (888) 700-9995 for unincorporated areas and cities under the County housing code. Long Beach, Pasadena and Santa Monica have their own code offices, and in Glendale or Torrance you call city hall. Our city-by-city mold complaint directory has the numbers.
Civil Code 1942.5 bars retaliation for asking for repairs or calling a code agency. If your landlord’s fix was only paint, read what to do when a landlord paints over mold. See the LA renter mold hub for more.
Rent during mold remediation: FAQ
Do I have to pay rent if I can’t live in my apartment during mold remediation?
Assume so until your landlord agrees to a credit in writing or a lawyer advises otherwise. Unpaid rent can lead to an eviction case.
Does my landlord have to pay for a hotel during mold remediation?
It depends on your lease, city and facts. Ask in writing before you book, keep your receipts, and talk to legal aid if the landlord refuses.
My landlord told me to move out for mold work. What should I do?
Ask for the reason, dates and plan in writing. Don’t sign anything ending your tenancy without advice. In an RSO unit, call LAHD first.
Is mold a constructive eviction?
It can be raised when serious, ignored conditions force a tenant out, but that is a legal question. Talk to a tenant lawyer before you move out.
Can I break my lease because of mold?
Possibly, but don’t assume it. Leaving without advice can leave you owing rent, and it can cost you a rent-stabilized unit. Contact Bet Tzedek or a tenant lawyer first.
Will renters insurance pay for a hotel?
It might. If the water loss is covered, additional living expense coverage may help. Confirm with your insurer before you book, and keep every receipt.
